Liability for defects in digital products
The statutory liability for defects pursuant to Section 327d of the German Civil Code (BGB) also applies to digital content. To create clarity and transparency, the following lists the circumstances that are considered genuine defects – and those that are not covered by statutory liability for defects.
What is considered a defect
An actual defect exists if the digital service is objectively faulty, for example:
- The file cannot be opened despite suitable technical requirements and devices.
- The provided download link does not contain a working file or leads nowhere.
- The audio file is completely silent or so damaged that it cannot be used.
What is not considered a defect
There are situations that do not constitute legally relevant defects and therefore do not give rise to any claims:
- Technical difficulties during download due to a lack of understanding of how to use Dropbox or similar platforms.
- Incompatibility with outdated or unsuitable playback software or hardware.
- Slight acoustic noises such as crackling, hissing or clipping, which can occasionally occur during light language transmissions.
- Individual perceptions of sound quality or frequencies based on subjective feeling.
- Effects or lack of effects that do not unfold energetically or emotionally as expected – every soul reacts individually.
- Hearing differences on different devices, especially when using simple speakers or mobile devices.
- The assumption that a file or session “should have been different” without there being an objective technical error.
Note on webinar recordings
Webinars and live sessions are conducted with the utmost care. Should technical problems occur during the recording , for example due to transmission errors on platforms like Zoom or disruptions beyond our control, no refunds are possible. In such cases, the contractually agreed service—participation in the live webinar—has already been provided.
